Sex Offenses
Students who are victims of sexual assault are encouraged to consider all appropriate avenues for legal action. If both the victim and the accused are students and the victim chooses to initiate the University judicial process, the victim will need to meet with a designated member of the Student Affairs staff. There are informal and formal options for consideration. Informal procedures involve mutually agreed upon resolutions, possibly including mediation, without formal charges of the Code of Conduct. Formal procedures would involve either an administrative hearing or a Judicial Board hearing to adjudicate the violations. In formal administrative or Judicial Board hearings, the accused and accuser need not be present at the same time as determined by the Hearing Officer or, in the case of a Judicial Board Hearing, the Affirmative Action Officer. In both informal and formal procedures, the sanctions are binding and the students will be held accountable for their actions.
