Administrative Action
The Vice President for Student Affairs, or his or her designee, may impose administrative sanctions such as warning, reprimands, fines or restitution, censure, probation and denial of privileges in the use of facilities whenever this becomes necessary to operate and protect property of the University properly. Adjudication of violations of residence hall policies and the Residence Hall Agreement are entirely within the jurisdiction of the Student Affairs Office. Sanctions involving suspension, dismissal and expulsion from the residence halls may be appealed to the Dean of Students. The decision of the Dean of Students on these matters is final, but in some instances, by request of the Dean, a case may be heard by the Judicial Board.
Persons accused of violations of other University Policies may choose to have the matter dealt with administratively or to ask for a hearing from the Judicial Board. Persons who elect to accept administrative adjudication may not subsequently appeal to the Judicial Board.
Sanctions for violations of the Code of Conduct as related to substance use have been defined for clarity for students. The University recognizes that alcohol misuse or other drug use is not simply a disciplinary matter. Generally, but depending upon the severity of the incident, when a student violates the University policy the first time, she or he is required to attend a mandatory group education session, a private educational-counseling session, and may be required to perform Community Outreach Activities. Students who do not fulfill the above expectations may receive at least a $25 fine and be charged with violations of the Code of Conduct for “failure to comply.” If a student violates the policy a second time, the student will be subject to disciplinary probation, the conditions of which may include, but are not limited to, a fine of $100, participation in a three part assessment to determine his or her relationship to mood-altering substances, and may be assigned Community Outreach Activities. A third offense results in a $200 fine, on-going counseling either on or off campus, the possibility of Community Outreach Activities , and probable removal from residence halls or other equally weighted consequence for non-resident students.
All Community Outreach Activities are assessed at the discretion of the administrator adjudicating the case. Students have four weeks to accomplish sanctions following a first offense, six weeks following a second offense and a maximum of two months following a third offense. Any additional sanctions may be adjudicated by the Judicial Board or through additional Administrative Hearing proceedings.
We value education as an important tool in helping students take a look at their decision-making. Follow up and further care will be determined on an individual basis. If necessary, outside referral or concurrent therapy with the Counseling Center staff or the Alcohol and other Drugs Educator/Counselor may be required. Additional information on these procedures and sanctions are explained in New Student Orientation, Residence Hall meetings and policy discussions, and through Commuter Assistants.
